I understand and agree as follows:

• I understand that nothing in this application is intended to imply or create a contract for employment.

• I further understand that, if hired, my employment is at-will and can be terminated at any time, with or without notice, and with or without cause. If I am employed, I agree to follow all of the company's rules and regulations and to perform the duties which may be assigned to me at any time.

• I certify that I have completed this application truthfully and completely and I authorize EK Innovative Engineering to verify all of my answers on this application. I authorize all persons or entities listed on this application to verify to the Company any information regarding me and hereby release the Company, its Agents and all said persons or entities from all liability to me; If I have not fully and honestly completed this application, either by omission or by making affirmative misrepresentations, the Company may reject my application or dismiss me from employment at any time.

• None of the above provisions may be waived or modified by EK Innovative Engineering unless in writing and signed by Human Resources of EK Innovative Engineering.

• I understand that I may be required, subject to applicable law, to take a pre-employment drug test as part of my application for employment.

• The Company and I agree to arbitrate any dispute that may arise regarding my application for employment and hiring decision related thereto. I understand and agree that this agreement to arbitrate covers any claim or dispute that the Company may have with me and that I may have against the Company or any of its employees, directors, affiliates, or assigns, regarding my application for employment or hiring decision related thereto (and any claims that are expressly excluded from arbitration). To the maximum extent permitted by applicable law, the Company and I agree that no claim covered by this agreement to arbitrate may be initiated, maintained, heard or determined on a class action, collective action, or representative action basis either in court or in arbitration. The Company and I further agree that I will not serve or participate as a class, collective, or representative action member or representative or receive any recovery from a class, collective, or representative action (whether in court or in arbitration) involving either any claim covered by this agreement. However, if, despite my and the Company’s express intent to proceed only in individual arbitration, a court nonetheless orders that a class action, collective action, or representative action should proceed, in no event will such action proceed in an arbitration forum and may proceed only in court.
